This page details the current terms and conditions for Salt & Earth. By securing your project, you are agreeing with the following terms below..

Quotes / Estimates + Payment
Charges for services to be provided by Salt & Earth are defined in the project quotation that the Client receives via e-mail. Quotations are valid for a period of thirty (30) days. Prices quoted are only an estimate, and may be subject to change during the process of design and build. This can be caused by the client choosing to amend any aspect of their requirements or any third party costs which occur beyond Salt & Earth's control. Any international payments or international bank transfers must be paid, by the client, in addition to the amounts invoiced by Salt & Earth. For projects under R5000 full payment is required before work begins on the project. For projects above R5000, a 50% deposit is required depending on the scope of the project. Full payment is required upfront for the following projects - Consulting, Marketing, Management, Training & Monthly Retainers. Any changes made after approval of the quote, including designs and any other material will incur a further charge. We do offer a 3 month payment plan that can be arranged prior to commence, this only applies to Branding & Website design work. Kindly note no creative, web or social work will be released before account has been settled in full.
Information we collect
When you enquire for pricing, we may ask for your contact information, including items such as name, surname, email address and telephone number. Your information will be stored in a client/enquiry database for the purposes of contacting you with information about your upcoming session and for future promotions. Kindly let us know if you are not comfortable with the information on file and we will remove your details from our database. More about our privacy policy below..
Copyright, Credit & Ownership
For Design & Social work:Copyright of Artwork will - For Websites: All files and access are granted on deployment of website. Salt & Earth will not have access or ownership & it is the clients responsibility to maintain their website. Credit: A link to Salt & Earth will appear in small type at the bottom of the Client’s website. If a client requests that the design credit be removed, a fixed fee of R550 will be applied. The Client also agrees that the website developed for the Client may be presented in Salt & Earth's ~ Carmen Niemand's portfolio and other marketing material. Kindly note that all work will remain the property of Salt & Earth until all outstanding accounts are paid in full. All training and mentor material will remain the copyright of Salt and Earth and we will appreciate you not copying our content and model to share with friends or to sell in any form.
Project leadtime
The lead-time of each project will be discussed and agreed on during briefing. For a high standard of quality to be produced, please allow sufficient time for the project to be completed. We do have a surcharge for projects that are urgent. Changes to the original brief will result in extending the timeline of your project & may incur further charges. Please note that delays in project from client side will incur further changes.
Non-disclosures
Kindly note that we do not sign any nondisclosures that will prevent us from working on similar projects or work with Brands with similar requirements, target audience & products/services. We agree that we will not convey any confidential information about the client to any third party and that each project we take on will be original & unique.
Content + Project docs
The client agrees to make available as soon as is reasonably possible to Salt & Earth all materials required to complete the site to the agreed standard and within the set deadline. Salt & Earth cannot take responsibility for any copyright infringements caused by materials submitted by the client. Clients are encouraged to follow the instructions of content handover in the correct formats to avoid confusion & to help the project run smoothly and avoid delays that will result in additional charges.
Liability
Salt & Earth cannot take responsibility for any losses incurred by the use of work created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all work is functioning correctly before use. The client is expected to test all work developed & designed by Salt & Earth before being made available for public use. Where “bugs”, errors or other issues are found after your project is live, Salt & Earth will endeavour (but is not obliged to) to correct the issues to meet the standards of function outlined in the brief.
WEB BROWSERS - We make every effort to make sure that websites are designed to work with the most popular current browsers. Client agrees that Salt & Earth cannot guarantee correct functionality with all browser software across different operating systems. Salt & Earth cannot accept responsibility for work which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the Client. As such, Salt & Earth reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.
Third Party Services - Salt & Earth cannot be held responsible for any alterations, modifications or deletions by a third party that has access or permissions given by the client before or after project handover.

Website security
The client is responsible for maintaining the security of their website, and are fully responsible for all activities that occur under their web domain account and any other actions taken in connection with their account. Clients are responsible for taking steps to maintain the confidentiality of their username and password. Salt & Earth can not be held responsive for any breach & malfunctioning caused by malicious traffic or third party access. To help secure your website, we offer retainers to maintain & update WP, plugins & Theme updates. We can also assist in other security measures that can be discussed in the project brief.
Retainers
All retainers T&C's will be discussed prior to agreement.
Meetings & Calls
Kindly note that all phone calls and meetings are scheduled by appointment only. Please WhatsApp or email all enquiries for a fast response or to schedule a call/virtual meeting. Please note all strategy calls and meetings will be charged for.
Termination
Termination of services by the Client must be requested in a written notice and will be effective on receipt of such notice. Telephone requests or text messages for termination of services will not be honoured until and unless confirmed in writing via email. The Client will be invoiced for project work completed to the date of first notice of cancellation for payment in full within thirty (30) days.
If the client has paid in advance, no refunds will be issued for the project work which has already been completed to the date of the first notice of cancellation or termination.
If the client decides they no longer want to continue with a project, as they have commissioned and paid for they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. We may limit or deny your access to support or terminate services if we determine, in our reasonable discretion, that you are acting, or have acted, in a way that results or has resulted in misuse of support or services, or abuse of our design team members.
